Terms of Service
Effective 2025
1. Overview
These Terms of Service ("Terms") govern your access to and use of qktag. By creating an account, scanning tags, or otherwise using the service, you agree to be bound by these Terms. If you are using qktag on behalf of an organisation, you confirm that you are authorised to accept these Terms on its behalf.
2. Eligibility and accounts
You must be legally able to form a binding contract in your jurisdiction to use qktag. You are responsible for maintaining accurate account information and for keeping your login credentials confidential. You must promptly notify us if you become aware of any unauthorised use of your account or a security breach.
3. Use of the service
qktag allows you to create and manage tagged items, attributes and attachments, and to expose some of that information via shareable links or QR codes. You may use the service only in accordance with these Terms and all applicable laws.
In particular, you must not:
- Use qktag to store or share content that is unlawful, defamatory, infringing, fraudulent, or otherwise harmful.
- Misrepresent your identity or affiliation, or attempt to impersonate another person or entity.
- Attempt to gain unauthorised access to any part of the service or its underlying systems, or probe, scan or test for vulnerabilities without permission.
- Reverse engineer, decompile or otherwise attempt to derive the source code of any component of qktag, except where permitted by applicable law.
- Interfere with or disrupt the operation of the service, including by overloading, flooding, spamming or scripting automated access in a way that degrades performance.
- Use qktag for high‑risk activities where failure of the service could lead directly to death, personal injury, or severe environmental or property damage.
4. Plans, subscriptions and billing
qktag may offer both free and paid plans. Free plans are subject to the limits and feature set displayed in the product (for example, on item counts or attachment availability). Paid plans unlock additional capabilities, such as higher quotas and expanded sharing controls.
- Paid plans are typically offered on a subscription basis and renew automatically at the end of each billing period unless cancelled in accordance with the cancellation process described in the product.
- You authorise us and our payment service providers to charge the applicable fees and any associated taxes to your chosen payment method on a recurring basis.
- If a payment cannot be collected, we may suspend access to paid features, convert your account to a free plan, or ultimately terminate the subscription, while preserving your underlying account where feasible.
- We may change plan pricing or features from time to time. Where changes affect an existing subscription, we will provide notice in advance through the product or by email, and the changes will apply from the next billing period or as otherwise indicated.
- Except where required by law, fees that have already been charged are non‑refundable. Any statutory rights you have, for example as a consumer, are not affected by these Terms.
5. Your content
You retain all rights to the content you upload or create in qktag, including item details, attributes, templates and attachments ("User Content"). You are responsible for ensuring that you have all necessary rights and permissions to store and share that content through the service.
To operate qktag, you grant us a worldwide, non‑exclusive, royalty‑free licence to host, store, reproduce, process, transmit and display User Content as reasonably necessary to provide, maintain and improve the service, including to render dashboards, generate public item pages when you enable sharing, and produce backups and logs.
You must not upload content that contains special categories of personal data (such as health information, financial account numbers, or government identifiers) unless the service is clearly designed for that purpose and you have all necessary legal bases to process it.
6. Intellectual property
The qktag service, including its underlying software, design, trademarks and branding, is protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, all rights, title and interest in and to the service remain with us and our licensors.
We grant you a limited, non‑exclusive, non‑transferable and revocable licence to access and use qktag for your internal business or personal purposes, subject to these Terms. You may not copy, modify, distribute, sell, lease or create derivative works based on any part of the service, except as permitted by law.
7. Privacy and data protection
Our processing of personal data in connection with qktag is described in the Privacy Notice available on this site. That notice explains what data we collect, how we use it, and the rights available to individuals under data protection laws such as GDPR. By using qktag, you acknowledge that your personal data will be processed as described in the Privacy Notice.
8. Service changes and availability
We aim to keep qktag reliable and available, but the service may be interrupted for maintenance, updates, or factors outside our control. We may add, change or discontinue features over time, and we may introduce new limits on usage where reasonably necessary to operate the service.
Where we make material changes that significantly reduce core functionality, we will use reasonable efforts to provide prior notice through the product or by email, taking into account the impact on active subscribers.
9. Suspension and termination
You may stop using qktag at any time and, where available, delete your account through the product. We may suspend or terminate your access to the service, or to specific features, if:
- You materially breach these Terms or applicable laws.
- Your use of the service creates a security risk, operational risk, or exposes us or others to potential liability.
- We are required to do so by law or by a competent authority, or discontinue the service in whole or in part.
Where reasonably possible, we will notify you before a suspension or termination takes effect and provide an opportunity to remedy the issue. Upon termination, your right to access the service will cease, but sections of these Terms that by their nature should survive (including those on intellectual property, disclaimers and limitations of liability) will continue to apply.
10. Disclaimers
qktag is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non‑infringement.
We do not guarantee that the service will be uninterrupted, secure, error‑free or meet your specific requirements, or that data stored in qktag will always be preserved without loss. You are responsible for maintaining appropriate backups of critical information and for verifying that qktag is suitable for your intended use.
11. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data, goodwill or business opportunities, arising out of or in connection with your use of qktag, even if we have been advised of the possibility of such damages.
To the extent permitted by applicable law, our aggregate liability for all claims relating to the service in any twelve‑month period will be limited to the greater of: (a) the amounts you paid to us for the service during that period (if any), and (b) any minimum amount that applicable law requires. Nothing in these Terms seeks to exclude or limit liability that cannot be excluded or limited under the law.
12. Governing law and disputes
These Terms apply to the extent permitted by the laws that apply to you. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Any dispute arising out of or relating to these Terms or your use of qktag should first be raised with us using the contact details below so we can attempt to resolve it informally.
13. Contact and changes
If you have questions about these Terms, you can contact us at support@qktag.com.
We may update these Terms from time to time, for example to reflect changes in our services or applicable law. When we do, we will update the "Effective" date above and may provide additional notice within the product. Your continued use of qktag after the updated Terms take effect constitutes your acceptance of the changes.
